Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the OpsPilot Systems customer relationship management service (the “Service”). By creating an account, accepting an invitation, or using the Service, you agree to these Terms. If you use the Service for an organization, you represent that you have authority to bind that organization.

If you do not agree, do not use the Service.

You must be at least 18 years old and legally capable of entering a binding agreement. Access is invite-only. An invitation is personal to its intended recipient and may not be transferred, sold, or shared.

We may accept, reject, revoke, or expire invitations and may restrict access when needed to protect the Service or its users.

You must provide accurate information, keep your credentials confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account unless prohibited by law.

You may not attempt to access another user’s records, bypass access controls, probe the Service for vulnerabilities without written authorization, or interfere with security features.

You retain ownership of information you submit to the Service. You grant OpsPilot a limited license to host, process, transmit, back up, and display that information solely as needed to operate, secure, and improve the Service.

You represent that you have the rights and lawful basis necessary to upload, use, and direct us to process customer data, including lead and contact information. You are responsible for the accuracy of your records and for responding to requests from people whose information you control.

The Service may send email through Gmail or a configured third-party endpoint when an authorized user initiates a campaign. You—not OpsPilot—select the recipients and content and are responsible for ensuring each message complies with applicable marketing, privacy, anti-spam, telemarketing, and consumer-protection laws.

You must not use the Service to send spam, deceptive messages, unlawful solicitations, malware, harassing content, or messages that conceal or misrepresent the sender. You must honor applicable consent, identification, unsubscribe, suppression, and recordkeeping requirements.

You may not use the Service to violate law or third-party rights; collect information through unlawful means; upload malicious code; disrupt or overload the Service; reverse engineer it except where law permits; resell access without written permission; or use automated means to extract data outside supported features.

You may not use information obtained through the Service to discriminate, stalk, exploit, or cause harm.

The Service may interoperate with Google Gmail, hosting providers, databases, or customer-configured email services. Your use of those services may be governed by separate terms and privacy policies. We are not responsible for third-party services outside our control.

You authorize us to transmit the information necessary to the provider you choose when performing a requested integration action.

OpsPilot and its licensors retain all rights in the Service, including its software, visual design, documentation, and trademarks, excluding customer data. These Terms provide a limited, revocable, non-exclusive, non-transferable right to use the Service for authorized business purposes.

If you submit feedback, you permit us to use it without restriction or compensation, provided we do not identify you publicly without permission.

We may modify, improve, suspend, or discontinue features. We aim to maintain a reliable and secure Service but do not promise uninterrupted or error-free operation. Beta or preview features may change or be withdrawn at any time.

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create security or legal risk, fail to maintain authorization, or misuse the Service. Where reasonably practical, we will provide notice and an opportunity to address the issue.

Sections that by their nature should survive termination—including ownership, disclaimers, limitations, and responsibility for customer data—will survive.

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. We do not warrant the accuracy of customer-entered data, email deliverability, sales outcomes, or continuous availability.

Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

To the fullest extent permitted by law, OpsPilot will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities arising from or related to the Service.

To the fullest extent permitted by law, OpsPilot’s aggregate liability arising from the Service will not exceed the greater of the amount you paid for the Service during the 12 months before the event giving rise to the claim or US $100. These limitations do not apply where prohibited by law.

We may update these Terms as the Service or legal requirements change. We will post the revised Terms, update the effective date, and provide additional notice when required. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
